| Claim Denied!: How to Appeal a VA Denial of Benefits | |||||||||||||||||||||||||||||
|
The VA is not your loving Uncle Sam who opens his wallet and says, Here you are, nephewa $1,000 check per month for the rest of your life. That should take the pain out of your service injuries, writes John D. Roche. Far from it, he reveals. Though the Veterans Claims Assistance Act of 2000 requires Veterans Affairs to assist veterans in developing the foundation to support their claims, in reality if you rely on the VA to find and develop the evidence necessary to grant benefits then your claim is likely to be denied. Claim Denied! will help those veterans whose benefits have been denied correct the mistakes they made when they submitted their original claims. Appealing a VA decision is not an impossible feat, Roche says, but a veterans story must be presented in a well-organized and logical format, so any reviewing authority is able to understand the issues as they relate to the laws. This book explains in detail how to develop and present a successful appeal.

Useful in trying to negotiate the minefield that is the VA system of Adjudication. It isn't always the system though; if you provide adequate evidence the journey isn't quite so difficult. An example would be combat awards. They serve as direct evidence of exposure to combat (not the boy scout Bronze Stars you see floating about... the 'real ones'... with the "V" device).
Main emphasis should be on seeking and receiving treatment for your service connected illness or injury. Once you establish connection the rest of the process will eventually fall into place. And yes... women are oftentimes overlooked and that alone is an injustice worthy of an entire volume. Prior comment: "Some male vets as well suffer trauma leading to PTSD from non-combat related sources." This is one of the main causes of whatever 'clog' there is in adjudicating combat related cases of Post Traumatic Stress Disorder. Too many ridiculously frivilous claims. Takes the novice through the steps one at a time. However, the time factor for the appeal to the end stage is not revealed. Reality, a year or two to fruition.

Virtually any veteran who has gone up against the VA's Claim Adjudication system has found to his or her dismay that, contrary to what the VA's mission is supposed to do, it is definitely NOT functioning in favor of the vet. The system is adversarial and often downright nasty, and often seems geared to outwait the veteran's lifespan before granting any amount of money or access to medical care. A guide to step-by-step battle against them is extremely helpful, and this book deals with only one aspect of a process that can overwhelm a sick or troubled vet. The author has a series of books dealing with various steps, and they are all good. One troubling aspect, however, is the concentration of combat as the only source of PTSD, and the total failure of the author to even mention women vets. Often, women vets suffer from other trauma sources, which may or may not include combat. Some male vets as well suffer trauma leading to PTSD from non-combat related sources, and the author should acknowledge these facts and adjust his books accordingly.
